Adoption Contract
This contract is between __________________ , purchaser, and Karen Kahn, Allure of the Brit breeder, hereafter referred to as purchaser and breeder.
This kitten/cat is being adopted as a pet, does not have the breeding rights, and must be spayed or neutered before the age of 8 months. If desired, the CFA or TICA registration documents and pedigree will be forwarded to the new owner after the veterinary proof of spay/neuter is provided to breeder. This must be arranged prior to purchase.
The kitten/cat is adopted in good faith and appears to be in excellent health and at an age appropriate weight. This kitten/cat shall NEVER be declawed since such a surgery is a cruelty against the animal. The breeder reserves the right to cancel any kitten adoption at any time prior to shipping or pick up.
It is expected that the purchaser will provide a loving home that cares for all the physical, medical and emotional needs of the kitten/cat throughout its life.
Under no circumstances will this cat/kitten be sold, leased, given away to any pet shop, research laboratory, animal shelter or similar facility. Should purchaser be unable to keep kitten/cat, the breeder is to be notified and a suitable new placement is to be approved by the breeder. Contract remains in effect with a new placement.
A nonrefundable $500.00 deposit is required to hold the kitten/cat. Balance of Adoption Fee is due prior to transporting or pick up. All vaccinations are current at the time of purchase. Purchaser is expected to provide further needed vaccinations.
The adopted kitten/cat is protected by a health guarantee against all life threatening genetic defects up to one year of age. Should it be found by a licensed veterinarian that this kitten/cat, in fact, has a life threatening genetic defect, upon written proof/necropsy, a replacement kitten/cat of comparable quality and value will be offered when available (within one year).
The purchaser has ten business days to have a veterinarian exam performed should purchaser so desire. It is recommended the kitten/cat be quarantined from other pets for a minimum of two weeks. Failure to have the kitten/cat examined within the ten days relieves the breeder of any financial responsibility and renders this contract void. After that any expenses incurred by the purchaser for the veterinarian or the treatment of the kitten/cat shall be the sole responsibility of the purchaser. Should medical treatment be necessary within the ten day period, upon proof, the breeder will be responsible for half of the incurred bill, for medication only.
Allure of the Brit holds a maximum liability for this kitten/cat’s adoption fee, less the cost of shipping.

This contract is legally binding to all parties involved. Any legal fees incurred in upholding this contract will be paid by the purchaser. Venue is in the state of California and in the county of Riverside. Purchaser’s signature indicates full agreement with terms. Facsimile signatures shall be enforceable as an original if original is otherwise unavailable.

KITTEN DEPOSIT AGREEMENT
This Agreement (“Agreement”) is entered into between Karen Kahn, Breeder, and ________________ (“Purchaser”).

DEPOSIT
Purchaser shall pay a deposit of $500.00 per Kitten, which shall be applied towards the Purchase Price for the Kitten. The balance shall be due and payable upon the release of Kitten to Purchaser. If Kitten is to be shipped, the balance is due and payable at least 14 days before the Kitten is shipped to the Purchaser.
The purpose of the Deposit is to ensure the Purchaser’s intent to purchase the Kitten. The Deposit is non-refundable, should the Purchaser, for any reason, change his/her mind and decide not to buy a kitten. This is because the Kitten is being held only for the Purchaser and shall not be sold to any other buyer. A breach of this Agreement either verbal, written or through neglect or failure to communicate by the Purchaser can jeopardize the chances of placing the Kitten in a new home as quickly as possible. For this reason, the Deposit is non-refundable, to ensure Purchaser’s commitment to purchase the Kitten, pay the balance and accept delivery of the Kitten by the date agreed by Seller and Purchaser.
The Deposit shall be refunded to Purchaser if the Seller fails to make the Kitten available to the Purchaser for reasons including, but not limited to, the Kitten’s mortality. However, Seller has the option of offering a replacement kitten of similar quality, which Purchaser may accept or decline.
PURCHASE PRICE
Purchaser has been given a price of $______ for the above kitten. A copy of the Contract is available for review on the Allure of the Brit website. If the Kitten is being shipped, we require that the Contract be signed and sent back to us (via email is acceptable) prior to the Kitten being shipped.
SELLER’S RIGHT OF REFUSAL
Seller reserves the right to refuse to sell the Kitten to the Purchaser at any time prior to the Kittens’ pickup or shipment. Seller's decision to cancel the sale shall be motivated solely by the Seller’s determination of the best interests of the Kitten. In that instance, Seller shall notify Purchaser in writing of its decision, the reasons for this decision, and Seller shall thereupon refund Purchaser's deposit, at which time, this Agreement shall be null and void.
GOVERNING LAW
This Agreement shall be final and binding upon the Purchaser and Seller and shall be governed by the laws of the State of California. Parties shall submit all their disputes arising out of or in connection with this Agreement to the exclusive jurisdiction of the Courts of California. In the event of a dispute between the parties, the prevailing party shall be entitled to his/her attorney’s fees and all costs and expenses associated with the dispute.
